French Parliament is making the first step in legalising P2P


At the end of 2005 the French National Assembly took a surprising decision
by adopting the draft law that transposes the directive on copyright in
information society with unexpected amendments. During a night meeting on
December 21/22, with only 10% of its members present, the National Assembly
adopted (30 pro and 28 against votes) an amendment legalising the exchange
of music and video files on the Internet, as private copies.

The amendment meant to complete paragraph 2 of art. 122-5 of the
Intellectual property Code is as follows:

" The author cannot forbid the reproductions made on any medium from an
on-line communication service by a natural person for his personal use with
no direct or indirect commercial purposes, except for the copies of a
software other than a backup copy, provided the reproductions make the
object of a royalty as stated by article L. 311-4 ."

The amendment comes in total contradiction with the project proposed by the
Minister of Culture Renaud Donnedieu de Vabres, establishing fines up to USD
360 000 USD and three years of imprisonment for natural persons condemned
for publishing copyrighted works.

The decision was saluted by the Association of Audionauts that suggests the
completion of the amendment text with a royalty tax collected from Internet
service providers. Those companies would likely raise the money by levying a
monthly fee ( they suggested 2 to 5 euros ) on customers who engage in a
certain amount of downloading and uploading.

Patrick Bloche, a Socialist representative from Paris who co-authored the
amendments, told the New York Times." We are trying to bring the law up to
date with reality. It is wrong to describe the eight million French people
who have downloaded music from the Internet as delinquents."

The draft must be approved also by the Senate in order to become a law
according the initial procedure and it is clear that the pressure groups
have not yet had their last word in this. In case of disagreement between
the two chambers of the Parliament a mixed commission will be created to
agree on the final text.

In an attempt to make a common ground for the adoption of the draft
copyright law, the Minister of Internal Affairs Nicolas Sarkozy, had a
common meeting on January 16, 2005 with the main actors from cinema, music
and Internet industries and representatives of consumers. The participants
agreed on 7 principles to be followed in the new legislative debates,
including ensuring the private usage of legal acquired works or allowing the
free sharing of the works for which theirs authors choose this option.

The latest news says that the debate will be resumed in the Senate in
February 2006

jednak francuzi raz za mesiac kompletne zmenia nazor. raz ta zavru, obesia za to, ze si pustis trosku nahlas legalne cd a raz vymyslaju taketo prilohy....

toto vyzera dobre, ale je to fakt zly zakon a v ziadnom pripade nechcem, aby presiel.

v prvom rade si nemyslim, ze je akokolvek ziaduce, aby provideri platili nejaku royalty tax za uzivatelov, ktori pouzivaju P2P siete. to je presne rovnaka chujovina ako to, ze platim za CD media nejaku taxu, ale ako autor obsahu z tychto penazi nevidim ani korunu. Tiez pisem clanky, robim softver, dokonca predavam softver (aj ked pod GPL :). Tiez si moje clanky niekto moze prefotit, z coho moj vydavatel nema radost. A ja za to nedostanem ani halier. Ani ziadny iny autor. Dostanu to velke medialne spolocnosti.

Proti su aj fakty, ze P2P siete neznizuju predajnost nosicov. Je fixna cena za CD. P2P siete a ine sposoby kopirovania jednoducho su. Ziadnym zakazanim alebo cimkolvek podobnym kopirovaniu nepredidu. CD, ktore sa mi pacia si rad kupim. Mam ich doma mnozstvo.

Tymto tahom budem platit providerovi a medialnym spolocnostiam, ked

a.) stiahnem si CD cez bittorrent. Stahujem legalne CD cez torrent velmi casto, pretoze ich mam doma najrychlejsie ako sa da. Ak su to cerstve CD, vydusi mi to linku na plny kotol, neriesim nejaky pomaly mirror. Taham.

b.) stiahnem, vypocujem, zmazem nieco, co sa mi nepaci


Dalej, "French Parliament is making the first step in legalising P2P". Titulok je dost zavadzajuci. P2P je legalne. Skype je P2P. Bittorrent je P2P a pouziva ho kopec firiem.

Dufam, ze volici su natolko rozumni, aby nedovolili takejto hovadine prejst. Ak to prejde, umozni to medialnym gigantom zarabat peniaze za nic, len ako dan za to, ze pouzivam nejaku technologiu. Dokonca pochybujem, ze ak aj piratim nejaku hudbu, autori, ktorych tym oberam o peniaze z toho nieco dostanu. Shakiru a podobne blbosti si stahovat nemusim a pochybujem, ze moj oblubeny Coil, Postal Service, Cyclobe, .... z toho bude nieco mat.

Takze z mojej strany k takymto zakonom jednoznacne nie.

nehovoriac o tom, ze toto vlastne prinuti providera sledovat, aky traffic robim. co sposobi dve veci: stupnu mu naklady (monitorovat a routovat traffic su dve odlisne veci a monitoring velkeho mnozstva trafficu je VELMI tazky), ktore sa prejavia v cenach aj mimo tejto "tax".

druha vec je, ze ma tym padom musi sledovat. ked uz mu zaplatim za technologiu, ktora mu to umozni, preco by nesledoval aj ine druhy cinnosti....
